Jekko Srl, in its quality of Data Processing Controller, pursuant to and in compliance with art. 13 of EU Regulation 679/2016 - General Data Protection Regulation (hereafter the “Regulation”), in order to supplement the general information provided by the website www.jekko-cranes.com, herewith informs you about the following:

➢ SOURCES OF PERSONAL DATA AND PURPOSE OF PROCESSING

In order to be able to use Jekko Lift Planner calculation simulator (hereafter the “Software”) the following personal data have to be communicated by you:

• Name and contact details of the data subject such as: name, surname, address, business e-mail address, business phone number, company.
• Credentials: user name and password for authentication and access.

The data collected are processed in order to fulfil the request of the data subject and allow him to access and use the Software. The legal basis is the execution of the contract of which You [as data subject,] are a party or the execution of pre-contractual measures adopted at the request of the same pursuant to art. 6, paragraph 1, letter B of the Regulation.

➢ CONSEQUENCES OF NON-PROVISION OF PERSONAL DATA

The provision of personal data is voluntary in nature. It is, however, necessary to the fulfilment of your request and access the Software. Therefore, your refusal to provide your personal data may result in you not being able to access and use the Software.

➢ CATEGORIES OF SUBJECTS TO WHOM THE DATA CAN BE DISCLOSED

Exclusively for the purposes mentioned in this information note, personal data can also be disclosed to third parties such as:

• IT service providers through the Internet related to the use of the Software

➢ DURATION OF DATA STORAGE

Your personal data provided to us to create your account will be stored only for the time necessary to achieve the purposes for which they are collected, i.e. as long as you are registered and use your account. Personal data will be delated 12 months after you last accessed Your account.

➢ PERSONAL DATA TRANSFER TO A THIRD COUNTRY AND/OR INTERNATIONAL ORGANIZATION AND RELATED WARRANTIES

Where necessary in order to fulfil the purposes of the data processing described in this Information notice, your personal data may be transferred to Countries outside the European Economic Area (“EEA”). Jekko Srl guarantees that any transfer of personal data outside EEA will be carried out in such a way as to ensure the full protection of your rights and entitlements. In the event that these third countries have not been deemed as adequate by the European Commission, personal data transfer will be in compliance with article 46 et seq. of GDPR including the standard contractual clauses adopted by the European Commission.

At any time, the data subject shall have the right to obtain confirmation from the data Processing Controller as to whether or not said data exists (right of access), to be informed about its content and source, verify its accuracy or request its integration, or deletion, or updating, or correction, or transformation into anonymous form, or processing limitation and data portability. Data subjects also have a right to lodge at any time a complaint with a competent supervisory authority or bring an action before the competent national courts.
